Overview

The reason for obtaining genuinely informed consent is far more than just a matter of tending to ethical or legal niceties. If the courts find that you treated your patient without consent, you can be held liable for any adverse outcome, including the known and normal risks associated with that treatment. That’s true even if there was no evidence of negligence in your performance of the procedure or in follow-up treatment. Further, the absence of informed consent can also lead to charges of medical battery. If the jury finds that you committed battery against the patient, you can be held liable even if both your performance of the procedure and the outcome were perfect and the patient suffered no injuries.

Objectives

Upon completion of this course, a physician should be able to:

1. Outline the information that must be shared with the patient to obtain informed consent.
2. E xplain the physician’s nondelegable duties in obtaining informed consent.
3. Describe proper techniques for documenting the patient education and informed consent processes.
  

Target Audience
This course is designed for physicians of any specialty who perform procedures or administer treatments that require informed consent.

Methodology

This is a self-study course consisting of text and CME test.  Physicians should read the course content, answer the test questions and submit the answers for scoring.  Those who complete the course with a score of 80 percent or higher will earn a maximum of 2 AMA PRA Category 1 creditsTM.
